Chapter 1 – Introduction

These TERMS AND CONDITIONS OF USE OF THE MOBILE PHOTOGRAPHY WEBSITE (hereinafter the “Terms and Conditions”) contain detailed information about your rights and obligations while using the Website and buying products via the online shop. By using our Website, you agree to these terms and conditions and acknowledge that you have read and understood them. Do not continue to use The Mobile Photography Website and products if you do not agree to all of the terms and conditions set forth on this page.

Chapter 2  –  Coursebooks

On our Website, you can find and purchase coursebooks on Mobile Photography, on Mobile Photography + Postprocessing, as well as a Masterclass on Mobile Photography (further referred to as the “Coursebooks”). The individual description of each product, including the language of the books, authors, number of pages, the functionalities covered, and any other information, you might find relevant, appears in the “Coursebooks” section of our Website, as well as during the time of purchase throughout the check out process.      

Chapter 3   –  Intellectual property rights and License:

Unless otherwise stated, we, The Mobile Photography and/or our licensors, own the intellectual property rights for all content on The Mobile Photography Site, including the Coursebooks being sold. All intellectual property rights are reserved. The Coursebooks are published under a pseudonym used by the authors.      

You may access The Mobile Photography content for your personal use only, subject to the restrictions outlined in these Terms and Conditions.     

The persons on the photos in the Coursebooks and the Website are not the authors of the Coursebooks. The photos in the Coursebooks or part of them may not have been taken by the authors of the Coursebooks. All photographs part of the Coursebooks and the Website are used lawfully, and their display in the Coursebooks does not infringe any rights of third parties.      

You can not:

  • Reproduce, distribute, modify, or create derivative works of our Coursebooks or Website content.
  • Copy or republish material from The Mobile Photography Coursebooks and/or Website.
  • Sell, rent, or sublicense any material from The Mobile Photography Coursebooks and/or Website.
  • Reproduce, duplicate, or copy any material from The Mobile Photography Coursebooks and/or Website.
  • Redistribute material from The Mobile Photography Coursebooks and/or Website.     
  • In any other way use material from our Website or Coursebooks for commercial or any other purpose other than personal use.      

Chapter 4  – Purchase and delivery

After you select a Coursebook of your preference by clicking the “choose” button you will access our checkout page. We offer four payment methods: credit/debit card, SEPA Direct debit, giropay, and PayPal. We also accept coupon codes as payment. If you enter your email on the checkout page and leave our Website without purchasing a Coursebook, you will receive a discount coupon automatically to your email after leaving the Website. The value of the coupons is deducted from the value of your order. The prices of our coursebooks shown on the website include all fees and taxes and no further payments will be charged by us upon checkout. However, there may be fees related to the payment method you choose. Please, keep in mind that those fees are not charged by us and are subject to change on behalf of the payment provider. 

All Coursebooks purchased are provided to you as digital content only and are available for download as a .pdf file after checkout. We do not sell or send hard copies of the books. After the purchase, you will receive an email with links to download the Coursebooks, and your Account on the Website will be autogenerated. You will receive an email with information on how to change the automatically generated access password to your Account. The purchased Coursebooks are also available for download in the Section “Downloads” in your Account.
You can also register an account at our Website using the “Login” Section without or before purchasing a Coursebook. 

Chapter 5  – Returns

If you are not satisfied with the coursebook you purchased, you have the right to claim a refund within 30 days of purchase, without citing any reasons. If you wish to exercise your right of withdrawal from the purchase, you can use the following withdrawal form or state in clear text your decision to withdraw from the contract by sending a message through the contact form available on the website or using the contacts described in Chapter 10 of these Terms and Conditions. In case you, as a user, exercise your right to withdraw from the purchase, we will reimburse the full price of your purchase (excluding any additional costs associated with your chosen payment method, if any) within 14 days of receiving your withdrawal.

Chapter 6  – Complaints and Dispute Resolution

If you have any issues with our service or product, please contact us through our contact form or using the contacts described in Chapter 10 below to discuss the matter. We will try our best to resolve the matter as quickly as possible and will provide you with a written response to your complaint within 7 days. If we require further information from you this period could be prolonged depending on the circumstances.

If we have not fulfilled our contractual obligations, you have the right to file a complaint and/or demand compensation. If we are unable to resolve your complaint, you have the right to use alternative dispute resolution methods such as mediation, or arbitration, or to seek legal protection of your rights before a consumer rights protection organization or a court of justice.

You have the option of resolving consumer disputes with the “Alternative Dispute Resolution” procedure on the territory of the European Union. Chapter 7 – Limitation of Liability

We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our coursebooks or website. Our liability is limited to the purchase price of the coursebook you have purchased.      

Chapter 8 – Changes to the Terms and Conditions

We reserve the right to modify these terms and conditions at any time without prior notice. Any changes to these terms and conditions will be effective immediately upon posting on our website. Your continued use of our website after any changes to these terms and conditions constitutes your acceptance of the modified terms and conditions.

Chapter 9 – Comments     

Comments on this Website do not reflect the views and opinions of The Mobile Photography, its representatives, and/or affiliates. Comments reflect the views and opinions of the users. To the extent permitted by law, The Mobile Photography shall not be liable for the Comments or any liability, damages, or costs caused and/or suffered as a result of the use and/or posting and/or appearance of the Comments on this Website.

The Mobile Photography reserves the right to monitor all Comments and to remove any Comments that may be deemed inappropriate or offensive or that violate these Terms and Conditions.
